India: The Telangana State Pollution Control Board has ordered Cement Corporation of India and Penna Cements to pay pollution fines for breaches of particulate matter restrictions at their respective cement plants at Tandur in Vikarabad district. The Times of India newspaper has reported that both companies exceeded legal limits eight times between November 2019 and July 2021. The board fined Cement Corporation of India US$3210 and Penna Cements US$4410.

US: Italy-based Buzzi Unicem subsidiary Lone Star Industries has concluded a settlement with the US Department of Justice, the Environmental Protection Agency and the state of Indiana over Clean Air Act violations at its integrated Greencastle plant in Indiana, dating from 2010 to the present day. The Indy Star newspaper has reported that under the terms of the settlement the producer must pay a fine of US$700,000. The authorities ordered the company to upgrade the plant in line with state and federal pollution regulations. The violations involved emissions of particulate matter that exceeded state and federal limits.

China: The Anti-Monopoly Bureau of the State Administration for Market Regulation has fined eight cement companies US$35m for price fixing. Caixin reports that seven companies in Shandong province formed Zibo United Cement Enterprise Management in 2017 to manage their arrangement through invoicing, sales, setting prices and coordinating operating regions. The extent of the anti-competitive behaviour between the companies extended to organising a price management committee to manage the arrangement by monitoring sales and even fining members in breach of its self-declared rules. As well as Zibo United, the other companies in the cartel were Shandong Baoshan Technology, Shandong Donghua Cement, Shandong Shanlü Environmental New Material, Zibo Luzhong Cement, Shandong Chongzheng Special Cement, Zibo Shanshui Cement and Linqu Shanshui Cement.

US: A US court has fined Argos USA US$20m for violations of antitrust rules between 2011 and 2016 with regards to the ready-mixed concrete market. The subsidiary of Columbia-based Cementos Argos subsidiary has admitted to collusion with another ready-mix producer. The US Department of Justice says that the companies coordinated price rises, submitted collusive non-competitive bids to customers, allocated markets in Southern Georgia and elsewhere and charged fuel surcharges and environmental fees.

Argos says the conspiracy was committed by, “a small number of former employees of a small, local sales office” that joined Argos when it acquired another company, according to Reuters. It added that its management “did not participate in or condone the conduct, which was undertaken in contravention of company compliance policies.”

India: The Tamil Nadu Pollution Control Board (TNPCB) has fined ACC subsidiary Madukkarai Cement US$61,000 for fugitive emissions of clinker and cement dust in mid-2020. The Hindu newspaper has reported that inspections found dust in the village Kurumbapalayam, Coimbatore District, located on the eastern side of the cement plant. An ambient air quality survey in September 2020 revealed higher-than-prescribed particulate volumes.

In addition to paying the fine, the producer must comply with 19 instructions of the TNPCB for air pollution control and monitoring by 7 January 2021.

India: The Indian Department of Mines and Geology has fined Trishul Cements around US$13.6m for the alleged unlawful extraction of 14,000t of limestone from the Konuppalapadu limestone mine in Andhra Pradesh. The Times of India has reported that the state government terminated its lease of the land in relation to Trishul Cements in February 2020. Investigations unearthed continued mining activity at the site in Anantapur District, along with two other companies’ sites in the Muchakota forest area of the district.

US: Dragon Products has been fined US$67,000 by the Maine Department of Environmental Protection for exceeding air emissions regulations since 2013. Ammonia, carbon monoxide and particulate matter levels were all breeched, according to the Bangor Daily News newspaper. Other irregularities with standards were also noted, such as baghouse inlet temperature limits and clinker cooler opacity standards.

US: Vicat subsidiary National Cement has received a fine of US$148,000 from the Alabama Department of Environmental Management (ADEM) for exceeding mercury emissions regulations over a 123-day period between May 2019 and February 2020 at its integrated Ragland plant in Alabama. The Daily Home newspaper has reported that unexpectedly high mercury levels in coal and other raw materials burned as fuel during that time caused the breach, which the company immediately reported to ADEM.

National Cement president Spencer Weitman said, “The issue took several months to fix.” Multiple upgrades and operational changes solved the issue, including installation of a US$400,000 mercury absorption carbon injection system. ADEM said, “National Cement did not economically benefit from the emissions violations.”

In January 2020 National Cement began work on construction of a new US$250m kiln line, due for completion in 2022.

US: Titan America subsidiary Roanoke Cement has settled on a fine of US$3640 with the Virginia Department of Environment Quality (DEQ) for the breach of emissions regulations after a kiln gas outlet at its 1.5Mt/yr Troutville plant in Botetourt County, Virginia, recorded an average temperature of 121°C over a nine-hour period on 26 June 2019. Virginia DEQ enforcer Marvin Booth said there was ‘no documented harm to public health or the environment’ resulting from the violation.

India: The Competition Commission of India (CCI) has fined Aditya Birla flagship company Grasim Industries US40.6m for anti-competitive practices, specifically for failing to disclose its discount policy as instructed by the CCI. Accord Fintech News has reported that cement accounts for almost 50% of Grasim Industries’ profit.
