India: The National Company Law Appellate Tribunal (NCLAT) has declined to stay insolvency proceedings against Jaiprakash Associates, following a challenge by its board. The board has been suspended since the NCLAT admitted an insolvency plea against the company on 3 June 2024. Press Trust of India News has reported that ICICI Bank first initiated proceedings over outstanding debts in September 2018.
The board of Jaiprakash Associates submitted that it will remain ‘asset-rich,’ even after it sells cement plants to repay loans. It attributed its present ‘liquidity crunch’ to delayed government approvals, ‘prolonged’ litigation and policy changes. The NCLAT stated that it must admit insolvency pleas in cases of defaulted debt repayment, saying that a judicial resolution will prevent further depletion of Jaiprakash Associates’ assets.
ICICI Bank issues invocation of Jaiprakash Associates shares
16 November 2023India: ICICI Bank has made an invocation of Jaiprakash Associates’ shares in relation to its debts. The Economic Times newspaper has reported that the producer owes US$360m to the bank. ICICI Bank is part of a consortium of banks owed a total of US$3.52bn by Jaiprakash Associates.
India: Aditya Birla subsidiary UltraTech Cement recorded cement sales volumes of 30Mt during the first quarter of the 2024 financial year, which began on 1 April 2023. This corresponds to growth of 20% year-on-year from first-quarter levels in the previous financial year. The Economic Times newspaper has reported that ICICI Securities expects UltraTech Cement's earnings before interest, taxation, depreciation and amortisation (EBITDA) to fall by 3% year-on-year. Declining fuel prices are expected to have contributed to a drop in the producer's costs. Throughout the quarter, its capacity utilisation rate was 90%.
India: ICICI Bank has asked the National Company Law Appellate Tribunal (NCLAT) to speed up an insolvency petition against Jaiprakash Associates. It said that there had been no progress on the plea since September 2019, according to the Hindu newspaper. The private bank alleges that the subsidiary of Jaypee Group has delayed the petition through adjournments of the process. It owes the bank around US$185m.
Jaiprakash Associates sold six integrated cement plants and five grinding plants to UltraTech Cement for US$2.5bn in 2017. It was reportedly in talks with LafargeHolcim’s subsidiary ACC in mid-2018 to sell its remaining cement business.
India: A representative of Jaiprakash Associates’ bank ICICI has told local media that its sale of assets to UltraTech Cement should be concluded ‘soon.’ ICICI Bank's managing director and chief executive officer Chanda Kochhar made the comments to the CNBC TV18 television channel in an interview. He added that the transaction was moving well in terms of regulatory approval. The deal covers over 20Mt/yr of cement production assets that are being sold for a value of US$2.4bn.
India: Ambuja Cement has launched a ‘Go Cashless’ campaign encouraging its business partners – retailers, contractors and masons - to adapt to cashless business transactions. The campaign follows the country’s decision to remove circulation of certain high denomination bank notes in November 2016. The campaign went live on 7 December 2016 and it is aimed to create awareness on various available cashless options amongst the cement producer’s business partners. Ambuja Cement is also working with ICICI Bank to launch a helpline to assist stakeholders open current accounts for regular business transactions.
“The ‘Go Cashless’ campaign is yet another endeavour empowering the construction community through knowledge transfer. We are successfully seeding innovative thinking at the grass-roots level and bringing information and technology to the forefront of all our esteemed business partners,’’ said Ambuja Cement’s managing director and chief executive .
The campaign has included sending out over 1,000,000 text messages, 200,000 Whatsapp messages and an educational radio campaign across 17 different stations in New Delhi, Himachal Pradesh, Punjab, Rajasthan, Gujarat, Maharashtra and West Bengal. Ambuja Cement estimates that it has contacted 42,000 business partners via media channels and over 4.5 million via radio.
