Cemex fined US$89,000 for omitted transactions
21 June 2022Mexico: The Mexican Federal Economic Competition Commission (COFECE) has fined Cemex US$89,000 for failing to notify it of a transaction that exceeded the threshold for notification. COFECE also approved the transaction in question.
Cemex has the right to seek legal recourse against the fine.
Cooperativa La Cruz Azul thanks Mexico City authorities for dismantling criminal network
16 June 2022Mexico: Cooperativa La Cruz Azul has taken to Twitter to thank the executive and judicial authorities of Mexico City for their work in dismantling the criminal network which had previously taken control of the producer. Prosecutors have indicted former Cooperativa La Cruz Azul legal director Victor N, who went into hiding in July 2020, and an alleged accomplice, Joel N.
Mannok secures injunction against Seán Quinn
26 May 2022Ireland/UK: An Irish high court has granted Mannok an injunction to prevent former Quinn Industrial Holdings CEO Seán Quinn from trespassing on the site of its Derrylin cement plant and quarry in Cavan and County Fermanagh, Northern Ireland, UK. The Irish Examiner newspaper has reported that the company cited safety concerns over Quinn's presence near industrial equipment and a sheer quarry drop. His media statement in 2021 that he would 'do anything' to remove its directors compounded Mannok's 'sense of unease.'
France: The Court of Appeals has confirmed a charge of complicity in crimes against humanity against Lafarge, now part of Holcim. The company will now appeal the decision to the Supreme Court. The confirmation establishes the scope of the charges that Lafarge will face, if unsuccessful in its appeal.
Global Cement previously reported that Lafarge allegedly made indirect payments to terror organisation ISIS between 2011 and 2014 in order to keep its Jalabiya cement plant operational during the Syrian Civil War. French prosecutors opened an investigation into the company’s activities in the country in June 2017, leading to its indictment for complicity in crimes against humanity on 28 June 2018.
Namibia: Immigration authorities have deported eight illegal Whale Rock Cement workers back to China. The Namibia Press Agency has reported that a court sentenced the Chinese nationals to deportation and fined them US$403 each.
Whale Rock Cement has reportedly launched its own legal action against vigilante workers’ rights group Namibia Economic Freedom Fighters (NEFF), which uncovered the illegal practices, for trespassing.
Court upholds Trinidad & Tobago cement import tariff
07 March 2022Trinindad & Tobago: The Caribbean Court of Justice has ruled against Hard Rock Cement in its challenge against Trinidad & Tobago’s 50% tariff on hydraulic cement. Nation News has reported that the Caribbean Community (CARICOM)’s Council for Trade and Economic Development (COTED) granted Trinidad & Tobago’s application to implement the new tariff in 2020. It remained in force for all of 2021. Cement importer Caribbean Cement challenged both the decision and the conduct of the application process.
Catalan court orders closure of LafargeHolcim España’s Montcada i Reixac cement plant
10 February 2022Spain: The Catalonia government has received a court order to close down LafargeHolcim España’s Montcada i Reixac cement plant in Barcelona. The Spanish Collection newspaper has reported that the plant failed to conform to new environmental regulations. LafargeHolcim España has appealed the decision.
The Montcada i Reixac plant currently employs 300 people. A union involved in the issue said that the alleged breach is formal rather than substantive and that an administrative error by the regional government caused the plant to breach the regulations.
Court permits Dalmia Cement (Bharat) to reopen Kadapa plant
03 February 2022India: Dalmia Cement (Bharat) has received clearance from the High Court of Andhra Pradesh to resume operations at its Kadapa cement plant. The producer had filed a writ against an order by the Andhra Pradesh Board Control Board (APPCB) to suspend production at the 2.5Mt/yr plant on 29 January 2021.
Mexico: 200 police officers in 80 police cars arrived outside the gates of Cooperativa La Cruz Azul’s Cruz Azul cement plant in Tula, Hidalgo, on 15 December 2021, but failed to enter the plant. The El Financiero newspaper has reported that the police were following a court order to remove the company from the plant. Supervisory board president Alberto Lopez reasserted the company’s right to occupy the property in line with federal government ordinances. Lopez suggested an alleged collusion between cooperativists and Omar Fayad’s Institutional Revolutionary Party (PRI) Hidalgo state government to decieve the courts.
Authorities have frozen Cooperativa La Cruz Azul’s accounts with outstanding bills of US$800,000 in electricity, gas, equipment and services bills, as well as the payroll of its 1100 workers.
Coopertiva La Cruz Azul chair Federico Sarabia said that the developments threaten the existence of the Cruz Azul plant. He said "In terms of quality, Cruz Azul’s cement exceeds the standard. At the time that Cruz Azul disappears as a cement producer, prices will increase.”
India: A Telangana court has blocked Southern Power Distribution Company of Telangana from disconnecting the power supply to some of Anjani Portland Cement’s cement operations in the state. The power supply is seeking to take the measure among other ‘coercive steps’ in an on-going dispute with the producer. Reuters News has reported that Southern Power Distribution Company of Telangana has issued a demand letter for alleged breach of obligations by Anjani Portland Cement.
