Vulcan Materials alleges illegal entry of Punta Venado terminal by Cemex

20 March 2023

Mexico: US-based Vulcan Materials has accused Cemex of illegally entering and unloading materials at its Punta Venado terminal in Quintana Roo. Vulcan Materials' subsidiary Sac-Tun operates the terminal, which serves its nearby Playa del Carmen quarry. Sac-Tun previously provided handling and unloading services at the terminal for Cemex, under a contract which expired on 31 December 2022. A local court ruled in favour of Cemex in the dispute over its continued use of the facilities on 5 March 2023. A high court intervened with an injunction in favour of Vulcan Materials on 16 March 2023.

Vulcan Materials now plans to take further legal action, according to Forbes. It is currently engaged in another legal dispute against the Mexican government for the latter's refusal to renew Sac-Tun's licence to operate the Playa del Carmen quarry. The producer is seeking damages of US$78.9m. The government said that the quarry had ceased to operate in line with requirements under its environmental impact licence and local land use plans.

Independent Cement and Lime secures Adbri cement distribution contract extension

09 January 2023

Australia: Adbri has extended Independent Cement and Lime (ICL)'s contract to exclusively distribute its products to the New South Wales and Victoria markets. ICL is a 50% subsidiary of Adbri. Volumes under the renewed contract will be similar to those during 2022, while prices will reflect market conditions. Adbri said that ICL distributes a 'substantial' proportion of the cement produced at its Birkenhead cement plant in South Australia.

Adbri's interim chief executive officer Mark Irwin said “Independent Cement and Lime is Victoria’s pre-eminent cementitious products distributor and is an important part of Adbri’s supply chain across Victoria and New South Wales. We are pleased to extend our distribution arrangement with ICL through to the end of 2023. We look forward to the commissioning in 2023 of the Melbourne cement facility’s new 45,000t silo at Port Melbourne, which will enhance Independent Cement and Lime’s ability to service the Victorian market.”

Adbri had previously considered buying Barro Group's cement assets, which included the remaining 50% stake in Independent Cement and Lime, in 2018.
