Kenya: East African Portland Cement Company (EAPCC) has won a legal dispute for the right to evict squatters from 1740 hectares of limestone-bearing land in Machakos County. Nation News has reported that the court struck out the case after claimants failed to produce requested documents. It also ordered the claimants to pay EAPCC’s legal costs.
BUA Cement allegedly considering legal action over gas price rise
06 December 2022Nigeria: The Daily Independent newspaper has reported that BUA Cement is allegedly preparing a 'multi-million dollar lawsuit' against its gas supplier, Greenville Liquefied Natural Gas (Greenville LNG). The supplier reportedly raised prices, as stipulated in the parties' gas supply contract, following an increase in its costs. Greenville LNG attributed the increase to the dilapidation of roads and collapse of upstream gas infrastructure due to flooding, as well as a lack of access to imports. It said that none of its 44 other industrial customers has challenged the price change.
Greenville LNG chair Eddy Van Den Broeke said "It is not a breach of contract because not only are we continuing the gas supply to the BUA cement plant in Sokoto, but also because we are discussing in good faith the changed business and economic conditions that afflict both companies." He concluded “In this case, we only activated the contractual price adjustment clause. We cannot explain how it is possible that social media misrepresented so grossly the present circumstances and the conditions of our contract, which were not reflected at all."
Kogi State government takes Dangote Industries to court
21 October 2022Nigeria: The government of Kogi State has filed a lawsuit against Dangote Cement's parent company Dangote Industries. The state government claims no payment was received for Dangote Cement's acquisition of the Obajana cement plant upon its privatisation in 2002, according to the Advocate newspaper. If the legal case is successful it could void the cement producer’s contract with the state government.
The National Security Council ordered the reopening of the Obajana cement plant in the national interest on 14 October 2022, following its closure by order of the Kogi State Assembly.
Adani Port seeks damages for Vizhinjam port construction delays
10 October 2022India: Adani Group subsidiary Adani Port has sued the government of Kerala for US$9.56m in compensation for on-going delays to the construction of the upcoming Vizhinjam port in the south of the state. A local church-led protest over the rights of fishing communities has stalled construction of the port. The New India Express newspaper has reported that Adani Port had lost over US$12m on 8 October 2022 as a result of the delay. The company rented 12 barges for the work.
The government will hold talks with protestors on 13 October 2022.
Namibia: Immigration authorities have deported eight illegal Whale Rock Cement workers back to China. The Namibia Press Agency has reported that a court sentenced the Chinese nationals to deportation and fined them US$403 each.
Whale Rock Cement has reportedly launched its own legal action against vigilante workers’ rights group Namibia Economic Freedom Fighters (NEFF), which uncovered the illegal practices, for trespassing.
James Hardie faces class action over HardieTex
11 August 2015New Zealand: Victims of leaky homes are being urged to join a class action being formed against James Hardie over one of its fibre cement cladding products, HardieTex.
Law firm Parker & Associates has filed a High Court case on behalf of a Wellington couple, who have claimed that HardieTex was the cause of their US$200,000 leaky home problem. The claim alleges that James Hardie was negligent in the design, manufacture and supply of HardieTex, which was used to build thousands of houses through the 1990s and early 2000s. Building owners who have suffered damage have until December 2015 to join the action.
The country manager for James Hardie in New Zealand, Justin Burgess, said that HardieTex is no longer on the market.
